About Emily

Former SEC investigative attorney. Regulatory-focused litigator helping companies and individuals navigate regulations and defending them in investigations. Emily Garnett uses her government experience, public policy background and litigation skills to advise clients on high-stakes regulatory enforcement and litigation matters. While at the U.S. Securities and Exchange Commission, Emily was a lead investigative attorney working on cases concerning potential violations of federal securities including accounting fraud, insider trading, registration requirements, cryptocurrencies and fraud. Emily uses her expertise and background at the SEC to advise clients under threat of investigation from other agencies, including: the Consumer Financial Protection Bureau (”CFPB“), the Federal Trade Commission (”FTC“), the Department of Justice (”DOJ“) and state attorneys general. On behalf of clients, Emily has drafted comment letters on proposed rules and regulations, including most recently, the SEC proposal on climate disclosures. Emily has also worked with public companies to perform mock audits and internal investigations, conduct company trainings, design compliance protocols and consult on procedures for public and private companies. Emily’s public policy background includes working at the American Enterprise Institute for former Speaker of the House Newt Gingrich and testifying before Congress on mark-to-market accounting. Her active role in state party politics positions her to provide insight on the relationship between litigation matters and financial regulations. She is well-connected to the local and state political communities and draws on those relationships to advance her clients’ best interests.
