Mark H. Bains

Mark Bains represents clients in a wide variety of real estate matters including commercial and residential real estate transactions, land use planning, and real estate litigation, including eminent domain actions, purchase agreement disputes, and lease disputes. Mark’s practice also focuses on construction law, where Mark represents residential and commercial contractors with negotiating and drafting of construction contracts, contract disputes, mechanic’s lien foreclosures, defective workmanship claims, and collection actions. Throughout Mark’s legal career, he has represented real estate developers before county and city boards of zoning appeals and plan commissions throughout Northeast Indiana. Born in Woodburn, Mark obtained a bachelor degree, cum laude, from Wabash College, where he was awarded a Presidential Scholarship and the Irwin-Garrard Award. He obtained his J.D., cum laude, from Indiana University Maurer School of Law, Bloomington. Mark is a member of the board of directors of Habitat for Humanity of Greater Fort Wayne and previously served on the board of directors of Young Leaders of Northeast Indiana (”YLNI“). He has been selected a for inclusion in the 2020 and 2021 Best Lawyers® in America publications in the area of Real Estate Law and was selected a ”Rising Star“ by the Indiana Super Lawyers© publication from 2017-2019. Mark and his wife, Erin, live in Fort Wayne with their son, Jack, and daughter, Emma. In his free time, He enjoys traveling, coaching youth sports, golfing, and spending time with his family and friends. Mark is admitted to practice before the Indiana state courts and the U.S. District Courts for the Northern and Southern Districts.
