Fred Kelly works extensively with life sciences companies. While he is primarily a trial lawyer, he also counsels life sciences companies on the False Claims Act, claims and class actions under state consumer protection acts, trade secret and non-competition matters; the licensing and protection of confidential and proprietary information; and product advertising and promotion. What do you focus on? I have successfully litigated and tried nearly every kind of commercial and product-related dispute that a life sciences company can have, in jurisdictions throughout the U.S. In particular, I have litigated and tried disputes involving clinical trial and licensing agreements, false advertising under state consumer protection acts and the Lanham Act, trademark infringement, off-label promotion, product pricing (AWP), consumer privacy, executive compensation, false claims, misappropriation of trade secrets and proprietary information, restrictive covenants and co-promotion agreements. Much of my recent experience is representing life sciences companies in False Claims Act cases, Lanham Act cases and in class actions brought under state consumer protection statutes. I have also served as national coordinating counsel in large product liability matters.
