Lynn helps clients navigate business-critical environmental compliance and transactional liability issues. Lynn assists a variety of companies with complex environmental issues across the United States including the agriculture, commercial development, retail, energy, chemical and product manufacturing, waste disposal, and the resort industries. She assists with compliance, permitting, and EPA and state enforcement matters arising under the Clean Air Act (CAA), the Clean Water Act (CWA), the Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA), the Federal Insecticide Fungicide and Rodenticide Act (FIFRA), and the Toxic Substances Control Act (TSCA). Lynn also has particular expertise counseling clients on chemical and product registration, development, and marketing claims compliance. Lynn also has extensive experience advising clients in corporate and real estate transactions involving potential environmental liabilities. She provides environmental due diligence, advice on deal structure to minimize risk, and negotiates related purchase and sale, lease, easement, and cleanup and indemnification agreements. She also negotiates environmental covenants, agency no-liability assurances, and agency approvals. In connection with transactions, she helps oversee environmental compliance audits/disclosures, assists with complicated permit transfers, and develops pre- and post-transaction risk mitigation strategies.
